INTENDED USES

We will use the personal data you provide solely to supply you with the products or services you have requested, or for other purposes for which you have given your consent, unless otherwise required by law.

RIGHTS OF DATA SUBJECTS

You have the following rights with respect to the personal data we hold about you:

  • Right of access,
  • Right to rectification or erasure,
  • Right to restriction of processing,
  • Right to object to processing,
  • Right to data portability.
  • You also have the right to file a complaint with a data protection supervisory authority regarding our processing of your personal data.

Right to withdraw consent or object to the processing of your data

If you have given your consent to the processing of your data, you may withdraw it at any time. Such a withdrawal will affect the lawfulness of the processing of your personal data after you have notified us of it.

Right to object on a case-by-case basis

If your personal data is processed on the basis of legitimate interests pursuant to Article 6(1)(f) of the GDPR, you have the right to object to the processing of your personal data pursuant to Article 21 of the GDPR, provided there are grounds for doing so arising from your particular situation. If you wish to exercise your right to object, a simple declaration (e.g., by email) to us is sufficient. If you exercise your right to object, we will cease processing the data in question. However, we reserve the right to continue processing if we can demonstrate compelling legitimate grounds for the processing that override your interests and rights, or if the processing is necessary for the establishment,

Right to Object to Direct Marketing

In certain cases, we may process your personal data for direct marketing purposes. You have the right to object at any time, in any form (e.g., by email), to the processing of your personal data for such marketing purposes. If you object to the processing of your personal data for direct marketing purposes, we will no longer use your personal data for those purposes.

THIRD-PARTY SERVICES IN THIRD COUNTRIES

If we use third-party services (e.g., providers of analytics tools, social media sites), data processing may also take place in a third country (pursuant to Articles 44–49 of the GDPR), particularly in the United States, by the respective third-party provider. Data will only be transferred if you have previously given your consent or if the transfer is based on contractual or legal grounds.

Please note the following: According to the European Court of Justice, the United States does not currently provide an “adequate level of protection” for the processing of personal data that meets EU standards. In particular, there is a risk that your data may be processed by U.S. authorities for surveillance and monitoring purposes, and you may not have any legal recourse against such measures.

DATA RETENTION

We store personal data for as long as necessary to fulfill our contractual, pre-contractual, and post-contractual obligations. This does not affect your right to erasure or restriction of processing. Furthermore, this does not affect our right to continue storing the data for legally compelling reasons (Art. 6(1)(c) GDPR) or where there is a legitimate interest (Art. 6(1)(b) GDPR). Legitimate interests include, in particular, the verification and enforcement of

USE OF COOKIES

In addition to the information mentioned above, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive and associated with the browser you are using, and through which certain information is transmitted to the entity that sets the cookie (in this case, us). Cookies cannot execute programs or transmit viruses to your computer. They serve to make the website more user-friendly and effective overall.

a) This website uses the following types of cookies, the scope and functionality of which are explained below:

Transient cookies (see b)

Persistent cookies (see c).

b) Transient cookies are automatically deleted when you close your browser. These include, in particular, session cookies. These cookies store a so-called session ID, which allows various requests from your browser to be associated with the same session. This enables your computer to be recognized when you return to our website. Session cookies are deleted when you log out or close your browser.

c) Persistent cookies are automatically deleted after a specified period of time, which may vary depending on the cookie. You can delete these cookies at any time in your browser's security settings.

d) You can configure your browser settings as you wish and, for example, refuse to accept third-party cookies or all cookies. Please note that you may not be able to use all the features of this website.

SAFETY

We employ technical and organizational security measures to protect the data you provide from accidental or intentional manipulation, loss, destruction, or access by unauthorized persons. When personal data is collected and processed, the information is transmitted in encrypted form to prevent misuse of the data by third parties. Our security measures are continuously updated in line with technological developments.

VIDEO SURVEILLANCE

We use video surveillance in certain areas of our hotel that are accessible to everyone, such as the entrances, reception, lobby, and chocolate lounge (shop). Audio recordings are not made. The purposes of video surveillance include, in particular, protection against break-ins, theft, fraud, misuse of services, vandalism (property protection), and assaults (personal safety). Furthermore, as the owner of the premises, we are authorized to take preventive and repressive measures necessary to protect the property, guests, and employees, or to prevent unauthorized entry.

We analyze video data only on a case-by-case basis and do not share it with third parties (with the exception of law enforcement agencies, attorneys, or courts).

The data is retained for 72 hours, unless there is reasonable grounds to believe that individual recordings will be used to enforce legal claims; in such cases, the recording will be retained until it is proven that the suspicion is unfounded or until the legal proceedings are finally concluded.

Video surveillance is permitted because it is necessary for the exercise of our property rights, in the public interest (e.g., law enforcement), or for the protection of our legitimate interests (e.g., protection against theft and vandalism) for specifically defined purposes, and there is no indication that the interests of the individuals concerned that warrant protection outweigh these purposes. The accessible areas where such video surveillance takes place are marked with a sign indicating that video surveillance is in operation.

The legal basis is Article 6(1)(e) and (f) of the GDPR.

Right to object on grounds relating to your particular situation: You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data contained in the video recordings that is carried out pursuant to Article 6(1)(f) of the GDPR (our legitimate interest). If you object, we will no longer process your personal data and will delete it, unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing is necessary for the establishment, exercise, or defense of legal claims.

JOB APPLICATIONS, RECRUITMENT PROCESS, SOFTGARDEN

We collect and process personal data from applicants for the purpose of handling the application process. This processing may also be carried out electronically. This is particularly the case when an applicant submits their application materials to us electronically, for example via email. If we enter into an employment contract with an applicant, the transmitted data will be stored for the purpose of managing the employment relationship in compliance with legal regulations. If no employment contract is concluded with the applicant, the application documents will be deleted six months after notification of the rejection decision, provided that no other legitimate interests on our part preclude such deletion. Other legitimate interests in this context include, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG). The legal basis is Art. 6(1)(b)

GDPR (processing for the performance of a contract, pre-contractual measures) and Section 26 of the Federal Data Protection Act (BDSG).

We use the Softgarden tool (a service provided by softgarden e-recruiting GmbH, Tauentzienstraße 14, 10789 Berlin) for application management and employer reviews. This allows us to manage applications more easily and efficiently. During the application process, you have the option to create a user account on the Softgarden career portal. There, you can view and manage your application.

The information generated by the cookies regarding your use of this website may also be transmitted by Google to a Google server in the United States and stored there. IP anonymization has been enabled on this website, so that the IP addresses of users within member states of the European Union or in other signatory states to the Agreement on the European Economic Area (EEA) are truncated by Google beforehand. Only in exceptional cases is the full IP address transmitted to a Google server in the United States and truncated there; we therefore draw your attention to the fact that data processing within the scope of Google Analytics may, under certain circumstances, also take place outside the scope of EU law in the United States. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website and internet usage to the website operator. This involves the integration of so-called tracking pixels on our pages. When you visit our pages, the tracking pixel establishes a direct connection between your browser and the Facebook server.
